General Terms and Conditions (GTC) of Offshore Luzern

1. Scope of Application

These General Terms and Conditions (GTC) apply to all services provided by Offshore Luzern, particularly boat rentals and boat excursions, as offered on the website www.offshoreluzern.ch.

2. Conclusion of Contract

The contract between Offshore Luzern and the customer is concluded when the customer makes a booking and Offshore Luzern accepts it. Bookings can be made via phone, email, WhatsApp, or through the website.

3. Payment Terms

  • Payment Methods: Payments are accepted exclusively via TWINT or bank transfer..
  • Advance Payment: Payments must be made in advance and received by Offshore Luzern no later than 48 hours before the booked appointment.
  • Deposit: A deposit of CHF 500 must be provided on-site in cash or via TWINT. The deposit will be refunded after the boat is returned, provided no damages or violations occur.

4. Cancellation Policy

Cancellation by the Customer:

  • Up to 7 days before the appointment: 100% refund.
  • 6 to 3 days before the appointment: 50% refund.
  • Less than 3 days before the appointment: No refund.

Cancellation by Offshore Luzern:

Offshore Luzern reserves the right to cancel bookings due to unforeseen circumstances (e.g., bad weather, technical issues). In such cases, the customer will receive a full refund or be offered an alternative date.

Special Regulation for Adverse Weather Conditions:
In case of adverse weather conditions such as storms, rain, or severe weather, it is possible to reschedule the booking free of charge, subject to mutual agreement with Offshore Luzern.

5. Liability

  • Exclusion of Liability: Offshore Luzern accepts no liability for personal injury or property damage occurring during the use of the boat.
  • Customer Liability: The customer is liable for any damages caused by improper use of the boat or violations of Offshore Luzern’s instructions.

6. Customer Obligations

  • Duty of Care: The customer is obliged to handle the rented boat with care and follow safety instructions.
  • Drinking and driving: Strictly prohibited.
  • Minors:May only participate when accompanied by an adult.
  • Boat License: The customer must present a valid boat license (Category A), unless they book the service with a captain.
  • Pets: Not allowed on the boat.

7. Rental Times and Instructions

  • Rental Times: The boat can be picked up no earlier than 09:00 AM and must be returned no later than 19:00 PM. For multi-day bookings and special requests, times will be agreed upon individually.
  • Instructions: Before taking over the boat, a briefing session (approx. 15 minutes), will be held, during which the operation of the boat and safety rules will be explained. The customer must then sign a rental agreement accepting the conditions.

8. Data Protection

Offshore Luzern uses personal data solely for processing bookings and does not share it with third parties. For more details, please refer to our Privacy Policy.

9. Jurisdiction and Applicable Law

Swiss law exclusively applies. The place of jurisdiction is Lucerne.

10. Severability Clause

Should any provision of these GTC be invalid, the remaining provisions shall remain unaffected.
